Terms and Conditions for J Series and Grand Prime Promotional Scheme.
Integrated Mobility Solutions Private Limited (Company) is introducing a promotional scheme ("Scheme") for the customer of Samsung Mobile Phone in Nepal. The terms and conditions applicable to the Scheme shall be follows:
1. Procedure for Participation and Conduct of the Scheme
1.1 Any customer who buys Samsung mobile’s J Series and Grand Prime Model during the period of Scheme can participate in the Scheme. The customer has to send the serial number of his/her newly purchased mobile phone ("Serial Number") through SMS to a predefined short code “5051”.
1.2 The Serial Number is located (a) on the space for battery on sticker in case of separate battery phone, or (b) on the back of the phone on a sticker in case of in-build battery phone.
1.3 The Serial Number sent through SMS by the customers shall be directly saved in the database of the Software in a safe manner. The Software will select the winning number from amongst the entries in the database in an automatic, random and unbiased manner.
1.4 An SMS shall be sent to all customers who have registered for the lucky draw acknowledging that their Serial Number has been registered for the lucky draw. However, customers that have purchases J Series and Grand Prime will only be eligible for the lucky draw.
2. Prize and Lucky Draw
2.1 The Company shall provide the attractive prize to the winners. The period of lucky draw and the prizes ("Prize") offered by the Company under the Scheme shall be as follows:
(a) Samsung Mobile Phone and Tablet: During the period of the Scheme, two (2) winners will be selected for “Galaxy Alpha”, “Galaxy J5”, Samsung Mobile Phone and one (1) winner for Samsung “Galaxy Tab T705” every day.
2.2 The lucky draw will be held every day to select the winner for Samsung Mobile Phone and Tablet. The daily lucky draw shall be held at 3:00 pm every day.
2.3 The winning serial no. will be posted on Samsung Mobile Nepal facebook page and the winner will also be informed through phone and SMS.
3. Eligibility for the Scheme
3.1 The Company, its employees, it’s advertising and promoting agencies and distributors and their employee or family members will not be eligible to participate in the Scheme.
3.2 The Samsung Mobile Phones sold to the customers by the authorized distribution channel only are eligible for the Scheme.
3.3 The Serial Number of the Samsung Mobile Phone which has been sold to the regional distributor of the Company after November 7, 2015 will be eligible to participate in the Scheme.
3.4 If any person not eligible for the Scheme is selected as a winner, the Company has the right to conduct the lucky draw again and select another person as a winner or cancel the lucky draw in which non eligible person is selected as a winner.
4. Validity Period of the Scheme
4.1 This Scheme shall be effective throughout Nepal from December 10, 2015 and last till December 27, 2015 unless otherwise decided by the Company. Except terminated/cancelled earlier, the Scheme will be deemed to have been ipso facto ends on December 27, 2015.
4.2 The period of the lucky draw will be from December 13, 2015 to December 27, 2015.
5. Procedure for Claiming the Prize
5.1 The winner shall claim his/her Prize within 2 (two) weeks from the date he/she is informed by the Company. After the expiry of this period, all the Prizes under the scheme will ipso facto be cancelled and the Company will not accept any claims of the prize under the Scheme upon expiry of the said two weeks period.
5.2 The winner submitting the claim for the Prize is required to collect the Prize from the Company’s office at KB Plaza, Durbarmarg, Kathmandu from 10:00 AM to 03:00 PM, from Sunday to Friday along with the prescribed documents within the prescribed time.
5.3 The winner, for collecting the Prize, shall submit (a) the document signifying his/her identity (Citizenship or Driving License or Passport), (b) the Samsung Mobile Phone with the serial number which has been selected as winner, (c) invoice issued by the seller of the Samsung Mobile Phone along with the IMEI number and customer phone number, and (d) one copy of recently taken passport sized photographs to the Company within the prescribed time.
5.4 The Company will not give any Prizes to the winner if he/she fails to submit the documents, proof or photograph within the specified time and the Prize will be ipso facto cancelled.
5.5 The same customer can win various prizes. However, the same Serial Number cannot win more than one Prize. The Serial Number once declared as the winner will not be registered in the database of the computer software. No claim will be made for the Prize in case any Serial Number is selected more than one time as the winner.
5.6 The customer shall keep the SMS, Samsung Mobile Phone with the Serial Number, and invoice for claiming the Prize.
5.7 The winner shall have no right to assign his/her prize to any third party.
5.8 The applicable withholding tax shall be borne by the winner himself/herself. The Prize shall be handed over to the winner once the applicable withholding tax is deposited by the winner to the Company.
5.9 The Prize is not convertible to cash in any circumstances.
6. Other terms and Conditions
6.1 The personal details of the winner shall be recorded by the Company and used for the purpose of the advertisement or promotion of business. The Company shall have the right to use the photograph, identity of the winner for its promotional activity free of cost.
6.2 The Company shall provide Prize to the winner remaining within the prevailing law of Nepal.
6.3 The warranty of the products given to the winners as the Prize shall be as provided by the manufacturers of such products. The Company shall not assume any product liabilities in respect of such products.
6.4 The customer shall pay the SMS charge at the normal rate charged by the concerned mobile phone operator. While sending SMS under this Scheme, the consumers may use the mobile service of Nepal Telecom or Ncell.
6.5 The Company has sole right to extend or shorten the period of the Scheme or cancel/ end/terminate the Scheme with or without any notice and without assuming any liabilities towards anyone in any circumstances at any time.
6.6 The persons participating in the Scheme will have to abide by all the terms, conditions and decisions of the Company. The decision of the Company with respect to the Scheme shall be final and binding to all the concerned.
6.7 All the rights relating to the Scheme shall be reserved to the Company itself.
